End User License Agreement

The short version: Steady90 is licensed to you, not sold. You get a personal license to use it on your own Apple devices, Apple is not a party to this agreement, and the subscription rules live in the Terms of Use.
1. Acknowledgement
This End User License Agreement ("EULA") is between you and Steady90 ("we", "the developer") only, and not with Apple Inc. ("Apple"). We, not Apple, are solely responsible for the Steady90 app and its content. This EULA does not override the Apple Media Services Terms and Conditions.
2. Scope of license
We grant you a personal, non-exclusive, non-transferable, non-sublicensable license to install and use Steady90 on Apple-branded devices that you own or control, as permitted by the Usage Rules in the Apple Media Services Terms and Conditions. The license covers the app itself; access to the program content requires an active subscription as described in the Terms of Use.
You may not copy, modify, distribute, sell, lease, or reverse engineer the app, except where such restriction is prohibited by applicable law.
3. Maintenance and support
We are solely responsible for providing maintenance and support for Steady90, as described on the support page. Apple has no obligation whatsoever to furnish any maintenance or support services for the app.
4. Warranty
Steady90 is provided "as is", as described in the Terms of Use. We are solely responsible for any product warranties, to the extent not effectively disclaimed. In the event of any failure of the app to conform to an applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any) for the app. To the maximum extent permitted by law, Apple has no other warranty obligation with respect to the app, and any other claims, losses, liabilities, damages, costs, or expenses attributable to a failure to conform to a warranty are our responsibility alone.
5. Product claims
We, not Apple, are responsible for addressing any claims by you or a third party relating to the app or your use of it, including but not limited to: (i) product liability claims; (ii) any claim that the app fails to conform to an applicable legal or regulatory requirement; and (iii) claims arising under consumer protection, privacy, or similar legislation.
6. Intellectual property
Steady90, its design, and its content are owned by us and protected by applicable intellectual property laws. In the event of a third-party claim that the app, or your possession and use of it, infringes that party's intellectual property rights, we, not Apple, are solely responsible for the investigation, defense, settlement, and discharge of that claim.
7. Legal compliance
You represent and warrant that (i) you are not located in a country that is subject to a U.S. Government embargo, or that has been designated by the U.S. Government as a "terrorist supporting" country; and (ii) you are not listed on any U.S. Government list of prohibited or restricted parties.
8. Third-party beneficiary
Apple, and Apple's subsidiaries, are third-party beneficiaries of this EULA. Upon your acceptance of this EULA, Apple has the right (and is deemed to have accepted the right) to enforce this EULA against you as a third-party beneficiary.
9. Termination
This license is effective until terminated. It terminates automatically if you breach any of its terms. You may terminate it at any time by deleting the app. Ending the license does not cancel an active subscription; manage subscriptions in your Apple ID settings, as described in the Terms of Use.
